US Airways will not disclose personal information to third parties without the user's permission, except as provided in this policy, and will take appropriate measures to safeguard the personal information shared with us. When US Airways requests sensitive information, commercially reasonable steps will be taken to establish a secure connection with the user's web browser to assure privacy.

At times users are asked to provide personal information to obtain a specific product or service. This information may include a user name, shipping address, billing address, telephone numbers, travel details, credit card information and e-mail address.

US Airways collects personal information to provide you with the most personalized online service. Your first name, last name, e-mail address and zip code will be used to receive scheduled e-mail newsletters, special discounted and partner offers, and other similar e-mail information. US Airways values its customers' privacy and thus will disclose customer-specific information only to carefully selected marketing partners. Customer-specific information will not be shared with third parties without a customer's express consent or unless compelled to do so by law or government authority. Any additional demographic information collected from US Airways customers (other than the specific information required to purchase a ticket) will be collected on an optional basis.

US Airways's web server uses cookies to determine whether users have previously visited the website. Cookies allow us to collect general usage information to customize and improve website services. General information collected by cookies may be disclosed to third parties in the form of aggregate data (such as overall demographic patterns) that does not describe or identify any individual user.

The US Airways Web site, www.usairways.com, offers customers the option to personalize and improve their online experience by creating a user profile. (The US Airways Vacations Web site, www.usairwaysvacations.com, does not offer a user profile.) US Airways customers are not required to create a profile to purchase a ticket. A profile is required to access specific areas of the web site, including FlightFund Account Access, FlightFund Award Reservations and My Online Reservations. If a customer chooses to create a profile, the following information is required: first and last name, address, phone number and e-mail address. In the event the user forgets his or her password, the user is required to answer five pre-established password recover questions. The answers to these questions are entered when the profile is created. Because customers cannot change the questions that are asked, the answers that are entered are at the discretion of the user. US Airways does not validate the information entered nor provide that information to any third parties. Customers may review and modify the information contained in their user profile at any time by logging into the site from the home page.

US Airways's web servers also use web beacon and other technologies to better understand what promotions are of interest to you. These technologies may be used on a number of pages on the website and allow us to tailor the content that we present to you online and in e-mails. Web beacons usually work in conjunction with cookies. If you do not want your cookie information to be associated with your visits to these pages, then you may set your browser to turn off cookies. If you turn off cookies, then we will still detect an anonymous visit, but the notices that the beacons generate cannot be associated with your particular preferences.

This site may, from time to time, provide links to sites operated by third parties. These sites are governed by different privacy policies. Please review the privacy policies of these sites. US Airways cannot be held responsible for personal information you voluntarily disclose to third parties. Please safeguard your personal information.

Users may update and correct personal information via the website for select products where indicated on the site (i.e. FlightFund information).

This privacy policy is subject to change. Should US Airways be required to make significant modifications to the policy, a statement notifying customers that a change has occurred will be posted on the home page for 21 days following the change.

User acknowledges that no joint venture, partnership, or agency relationship exists between user and US Airways and agrees not to hold herself or himself out as a representative, agent, or employee of US Airways.

Users warrant that all information provided by the user or a member of the user’s household is true and accurate. False, speculative, or fraudulent reservations or reservations in anticipation of demand are strictly prohibited. If US Airways determines that an individual has confirmed reservations to one or more destination(s) on or about the same date(s), US Airways reserves the right to cancel all confirmed seating associated with the multiple reservations without notice to customer. User agrees that the use of this travel service is for legitimate reservations or purchases.

User agrees to abide by terms or conditions of purchase imposed by US Airways or any supplier with whom user elects to deal including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of fares, products or services. User shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this website.

User agrees not to assign, transfer or sublicense user’s rights pursuant to this Agreement. US Airways reserves the right to change or modify the terms and conditions of this Agreement. User is responsible for regularly reviewing these terms and conditions. Continued use following any change constitutes user’s acceptance of such changes.

Liability Disclaimer

The information, products, and services published on this website may include inaccuracies or typographical errors. Changes are periodically made to the information provided. US Airways and/or its service providers may make improvement and/or changes to this website at any time.

Forum Selection

This Agreement shall be deemed to have been made in the State of Arizona, USA and shall be interpreted, and the rights and liabilities of the parties hereto determined in accordance with the law of the State of Arizona, USA, without regard to conflicts of law principles. The parties consent to the exclusive jurisdiction of the state and federal courts for the County of Maricopa, Arizona, USA for the determination of any claim or controversy between the parties and arising out of or relating to this Agreement. Both parties hereby consent to the jurisdiction of the Arizona courts and waive any objections as to personal jurisdiction or as to the laying of venue in such courts due to inconvenient forum or any other basis.

Damages

US Airways and/or its service providers shall not be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of this website or with the delay or inability to use this website, or for any information, product, and service obtained through this website, or otherwise arising out of this use of this website, whether based on contract, tort, strict liability or otherwise, even if US Airways and/or its service providers has been advised of the possibility of such damages. Because some states and/or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply.
